The Department of Labor and Employment reiterates the obligations of employers to their household service workers (HSWs) or kasambahays as mandated under the Republic Act 10361 or the Kasambahay Law.

Atty. Ma. Karina Perida-Trayvilla, Director of the Bureau of Workers with Special Concerns, emphasized all the responsibilities of both employer and household worker, especially during the COVID-19 pandemic.

“According to the law’s implementing rules and regulations, the employer should have a signed contract between the kasambahay, which states all the duties and responsibilities, period of employment, compensation and authorized deductions, rest days and allowable leaves, as well as other lawful conditions agreed upon,” Trayvilla said.

Moreover, kasambahays should be mandatorily covered by social protection benefits such as Social Security System (SSS), PhilHealth and Pag-IBIG.

During the pandemic, kasambahays are one of the most at-risk of contracting COVID-19. In this case, employers should not terminate their contract; instead, they should help their workers with hospitalization, especially for those who did not enroll their domestic workers in SSS or PhilHealth.

“The Occupational Safety and Health Center also reminds the public to follow safety protocols at home like physical distancing, regular handwashing, disinfection of our surroundings, as well as provision of appropriate personal protective equipment for our kasambahays,” Trayvilla remarked.

In addition, the DOLE released Labor Advisory No. 17 s. 2020, or the clarificatory guidelines on handling kasambahay cases, which strengthens the Department’s efforts in protecting the rights of these workers especially during the pandemic.
